Le prove Invalsi sono obbligatorie?

I Cobas della scuola sono di nuovo all’attacco sul carattere a loro
avviso non obbligatorio delle prove nazionali Invalsi, ma precisano
la loro strategia avvalendosi anche del parere dell'avvocato dello
Stato Laura Paolucci: le prove sarebbero sì obbligatorie per gli
studenti, ma non per i docenti perché la loro somministrazione non
rientrerebbe nell'attività ordinaria di scuole e docenti.

Scrivono i Cobas in un nota pubblicata sul loro sito: “L’Invalsi è
liberissimo di predisporre tutti test che ritiene ma il punto della
questione è un altro: la somministrazione delle prove e tutte le
operazioni connesse (dall’anno scorso ai docenti è stato di fatto
assegnato anche il compito di riportare le risposte degli alunni
sulle apposite schede di rilevazione predisposte dall’Istituto)
comporta un lavoro aggiuntivo che non rientra fra i compiti
‘obbligatori’ del docente che, quindi, non è tenuto a svolgerlo”. E
comunque i docenti che decidessero di accettare tale compito
aggiuntivo dovrebbero essere remunerati con il fondo di istituto.

I Cobas della scuola del Piemonte, in particolare, citano una
recente circolare dell’Usp di Torino con cui si trasmette alle
scuole il testo di un intervento dell’avvocato dello Stato Laura
Paolucci per ribadire che “i test invalsi devono essere
somministrati obbligatoriamente dal personale che lavora per
l'invalsi e non dagli insegnanti delle scuole pubbliche”.

L’avvocato Paolucci sostiene infatti che “l’Invalsi potrebbe,
volendolo, ‘scavalcare’ completamente le istituzioni scolastiche
nella realizzazione della propria funzione istituzionale, decidendo
di somministrare le prove in un ‘luogo’ diverso dalle sedi e dai
plessi scolastici: una simile scelta sarebbe più ‘complicata’ dal
punto di vista organizzativo e certamente più costosa, ma sarebbe
compatibile con la normativa”.
